Gegenstand der Untersuchung bildet das Recht der forensischen DNA-Analyse. Aufgezeigt wird – abstrahiert sowie für die jeweilige Ermächtigungsgrundlage gesondert –, dass die im Jahr 2018 erfolgte Novellierung des Datenschutzrechtes auf EU-Ebene auch Einfluss auf Anwendung und Auslegung der §§ 81e ff. StPO hat. Behandelt werden daneben Fragen des Rechts der DNA-Analyse, die losgelöst von datenschutzrechtlichen Implikationen eine abschließende Behandlung noch nicht erfahren haben.
