»The Clergy‘s Privilege – Unconstitutional Special Religious Right? § 139 sec. 2 StGB and the Constitutional Protection of Life and Physical Integrity«: The state has a duty to protect, amongst others, the legal interests of life and physical integrity. For these interests, the clergy's privilege under § 139 sec. 2 of the German Penal Code creates a lack of protection. This study examines, whether this can be justified by the special significance of religious freedom.
