Through an analysis of the limitations of international law to protect individuals from human rights violations connected to mineral exploitation, this book explains how the fragmentation of international law is not only affecting the capability to protect global interests, but also threatening the systemic operation of international law. In this regard, this work presents three expressions of how the fragmentation of international law impacts the response to mineral violence. First, fragmentation impacts how a legal operator classifies and assesses a particular situation, and hence what objectives it considers necessary to achieve. Therefore –and second– fragmentation affects the tools legal operators choose to respond to the situation because the response will be limited to the objectives pursued. Third, fragmentation creates conflicts in the application of international obligations pertaining to distant special regimes, due to the fact that the interpretations rendered by decisionmakers are inherently biased towards the interests of the special regime to which they pertain.
