This book presents a timely analysis of prosecutorial policy and practice in cases of domestic violence, using the concepts of feminism and neoliberalism to examine how they have affected prosecutorial practice. This book proposes a more nuanced therapeutic model for women who do not desire a prosecutorial response. The practice of pursuing ‘tenacious prosecutions’ is explored and the effect of the feminist movement successfully moving domestic violence from the public sphere to the private sphere on criminal justice responses. It is questioned whether the notion of privacy needs to emerge, this time with a focus on the dignity and autonomy of the survivor, who may feel that the coercion they experience by their abuser is replaced by state coercion through the use of ‘tenacious prosecutions’. The debate is supplemented by unique empirical research carried out with prosecutors and survivors of domestic violence, with findings highlighting the different ways the criminal justice process is experienced by domestic violence survivors.
