»Case Management by Civil Law Judges«: The civil process has structural deficiencies that cannot be explained by external factors alone. Instead, human weaknesses of the judges have to be taken into consideration as well. The paper therefore suggests a reform of the ZPO which aims to hold the parties more accountable.
