Die Arbeit befasst sich mit dem vielschichtigen Interessenausgleich sowie der technikrechtlichen Regulierung an der Schnittstelle von Energiewirtschaftsrecht und Datenschutzrecht. Im Smart Grid wird für die Optimierung von Regulierungswissen ein Verfahren der Bundesnetzagentur vorgeschlagen. Durch dessen Anreicherung um Aspekte der datenschutzkonformen Technikgestaltung kann eine Komplexitätsreduzierung auch durch Visualisierung - angelehnt an das Bau- und Planungsrecht - erreicht werden. This work is concerned with regulation and the reconciliation of interests at the interface of energy sector and privacy law. To improve regulatory knowledge within the Smart Grid, an existing procedure of the Federal Network Agency is proposed. By enriching this procedure through aspects of data protection compliant technical engineering and elements of visualisation - drawn from construction and planning law - it is also possible to reduce the complexity of regulatory knowledge generation.

Enterprise software helps organizations comply with laws and regulations, yet software itself creates negative externalities that can undermine rights and laws. Software developers are an important regulatory force, yet many know little about how law and software interact. This work examines developer understanding of legal concepts and examples of the software code and law relationship: payroll, Sarbanes Oxley Act, web accessibility, and data protection.

Verwaiste Werke können kulturell erwünschte Nutzungen vorbestehender Inhalte verhindern. Die Arbeit beschäftigt sich grundlegend mit diesem Problem. Die internationalen Entwicklungen werden nachgezeichnet, verschiedene Lösungsansätze werden dargestellt. Konkret wird darauf eingegangen, wie die deutsche Regelung (§§ 61 ff. UrhG) es nicht nur ermöglicht vorbestehende Inhalte besser zu nutzen, sondern auch gestaltend auf die Urheberrechtspraxis einzuwirken. Orphan works can prevent the culturally desirable use of pre-existing content. This work treats the problem in a fundamental way. It describes the international developments and different approaches to solving the problem. Specifically, it discusses, how the German regulation (§§ 61 ff. UrhG) not only allows the better use of pre-existing content, but also how it makes it possible to influence copyright practice.
